1.2 Any reference to “you” refers to you as a user of this website.

1.3 Any reference to “us” refers to Alberta Ballet residing at 141 18th Avenue SW, Calgary, AB T2S 0B8.

1.4 Any reference to this “website” refers to the website address vipexperience.albertaballet.com and such other locations where it may be hosted or featured where the entire website or elements of the website are hosted or featured by our partners.

1.5 This website is operated for the benefit of raising awareness and funds for Alberta Ballet’s performances and programs.

1.6 Alberta Ballet, to the best of their ability, thrives to provide accurate descriptions and depictions of the items being auctioned, it cannot guarantee and cannot be held responsible for loss or damages if different from the expectations of the bidder.

2. Eligibility

2.1 You must be a minimum age of 18 to bid on an item and use this website. Furthermore you must be able to enter into legally binding contracts. By bidding and using this website you warrant that you are 18 or older, have the capacity to enter into contracts and understand your obligations under these Terms & Conditions.

2.2 You will not be eligible to use this website if you have previously been banned from using it and a ban is currently still in place, or where you have been suspended and a suspension is still in place.

3. Registration

3.1 As part of the bid process you will need to provide your first and last name, your email address and your phone number. It is your responsibility to ensure that the information you provide is accurate, not misleading and relates to you. You cannot make a bid using the names and information of another person or using words that are the trademarks or the property of another party (including ours), or vulgar, obscene or in any other way inappropriate. We reserve the right with or without notice to suspend or terminate any account in breach.

3.2 If for any reason you suspect that your email address or your phone number has been disclosed to or obtained by another party you should contact us immediately. Please note that we never contact users requesting them to confirm their personal information or other details.

4. Specific Auction Rules

4.1 As a bidder, you agree that your offer is irrevocable if you are the winning bid and that you are contarctually obliged to complete the transaction. Therefore you agree not to do any of the following:

4.2 The bid has to be equal to or above the minimum bid indicated in order to be a winning bid. Bids below the miniumum will not be accepted as the winning bid.

4.3 Fail to pay for any item purchased by you, whether sold at a fixed price or auction. This excludes where Alberta Ballet materially alters the terms of the sale after you have bid or agreed to purchase.

4.4 Manipulate the bidding process or price of any item, including (but not limited to) bidding for your own items, working in conjunction with others to bid-up items, entering high bids and then withdrawing them, or any other form of manipulation or concerted action to distort the auction process.

4.5 The above list is not intended to be exhaustive. We reserve the right to remove (with or without notice) content and suspend or terminate (with or without notice) the placed bid of any user who in our sole judgment is in breach of the rules or the spirit of the rules.

5. Refund Policy

5.1 Alberta Ballet is a not-for-profit and the auction’s purpose is to raise funds for our programming. As the such the monies raised cannot be refunded as the opportunity to solicit funds through the auction is no longer available to us after the close date. 

6. Applicable Tax

6.1 As Alberta Ballet is a registered charity in the Province of Alberta. All taxes, such as 5% GST are applicable and will be added to the your final payment.

7. Applicable Law

7.1 Use of this website constitutes agreement to the terms and conditions and the interpretation of its terms shall be governed by and construed in accordance with the laws of Alberta, Canada and subject to the exclusive jurisdiction of the federal and provincial courts located in Alberta, Canada.

8. Indemnification

8.1 By using this website, you agree to defend, indemnify, and hold harmless the Alberta Ballet from and against any all third-party claims (or other actions that could lead to losses by Alberta Ballet) that are based upon  (a) violation of the law, (b) violation of this Agreement, or (c) violation of any third party’s rights.
